1- INTRODUCTION

The general terms of sale specified below (hereinafter referred to as "General Terms"), govern the contractual relations between any user of the website www.fire-design.fr (hereinafter referred to as a "User" or "You") and the brand name Fire design of the company Sécurité Incendie Européenne (SIE) Sarl, with registered capital of 30,000 EUROS, the registered office of which is situated at 45, avenue de la Faisanderie - 94290 Villeneuve le Roi and registered with the Trade and Companies register of Creteil under the number B 389390832.

Fire design is a brand name filed with INPI under the number 083605810

Sécurité Incendie Européenne is the owner and operator of the Fire design brand.

No other terms shall apply other than the present general terms of sale, which replace any other terms, except for any prior, express and written exemption.  SIE may occasionally amend certain provisions of its general terms, which must be read each time the website www.fire-desing.fr is visited. These amendments are binding as soon as they are put online and may not apply to previously agreed contracts. Each purchase on the website www.fire-design.fr is governed by the general terms that apply at the date of the order. We consider that by validating your order, you accept without reservation our general terms of sale, once you have read them.
On entering the website www.fire-design.fr, you undertake to abide by the General Terms and the Terms of Use shown therein.


2- PRODUCTS

2.1: Compliance
Products offered for sale by the Fire design brand and marketed by the company SIE comply with the standards that apply in France.
Elements such as notably photographs, texts, graphics and any information and characteristics illustrating and/or accompanying products are not contractual.
The consumer is the sole judge of the compatibility of ordered products with equipment already in his/her possession. SIE may not be held liable for any use that fails to comply with its recommendations shown in the instructions for use. Hence, Fire design extinguishers are designed to extinguish small home fires; under no circumstances do they exempt users from having to submit an insurance claim or requiring the services of fire safety professionals.

2.2: Availability
You acknowledge that your order is fabricated at your request with material of different colours in stock in our workshops. In the event that one of these ordered colours is not available in stock, we undertake to contact you by email, within 5 days of the date of your order, if need be, to inform you thereof and to advise you how long the product could be delivered to you.

2.3: Prices
Sales prices shown on the website www.fire-design.fr are in euros and all taxes are included, but delivery costs are not included.


3- PLACING AN ORDER

3.1: Moyen de paiement
To place your order, there are 2 means of payment at your disposal: - by internet via our website: www.fire-design.fr, 24/7 - by mail together with a printout of your order and your mode of payment by cheque – payable to SIE and addressed to: Sécurité Incendie Européenne, 45, avenue de la Faisanderie – 94290 Villeneuve le Roi. We shall then confirm receipt by email.
In any event, the sales contract shall only be deemed entered into, once the consumer's account has been debited for credit cards or on the date of receipt of the cheque.

3.2: Le Consommateur ou « utilisateur »
The consumer expressly declares having all authorisations required for the purposes of using the mode of payment that s/he chooses when validating his/her order.
Furthermore, s/he undertakes to ensure his/her solvency prior to any order, a prior condition for the company SIE to proceed with the delivery of the ordered products.
Moreover, the website www.fire-design.fr reserves the right to suspend or cancel any order or delivery in the event of refusal of payment authorisation by financial bodies questioned in relation to the mode of payment chosen by the consumer.
Likewise, it reserves the right to refuse an order from or make a delivery to an internaut with whom a dispute exists, notably with regard to payment of a previous order.
Furthermore, the consumer is advised that the company SIE may perform an analysis or verification of placed orders to combat fraud, as part of which the company SIE reserves the right to request from the consumer any proof that it would consider relevant.
Once this procedure has been completed, it reserves the right to suspend or cancel any order or delivery, even in the event of authorisation of payment delivered by the financial bodies concerned, should this analysis and/or verifications indicate that the said order was in violation of the rights of a third party.
Moreover, it shall not be held liable in the event of misappropriation of funds or fraudulent use of any means of payment that is not detected by this procedure of analysis and/or verification.


4- MODE OF DELIVERY

Products purchased on the website www.fire-design.fr may be delivered in all countries shown in the drop-down menu of the website. Your order shall be delivered to the address that you specified when placing your order. For deliveries, SIE has chosen: COLISSIMO. This choice of delivery enables you to receive your parcel within 48 hours* thanks to la Poste and to the Colissimo follow-up service. Your order shall be processed within 2 weeks and shall be sent by post. SIE undertakes to adhere to the delivery times shown on the website www.fire-design.fr.   However, we may not be held liable for consequences of a delay in delivery or loss of a parcel caused by a third party or through your own doing or because of an unforeseeable and unavoidable cause constituting an Act of God.
In the event where a parcel is not delivered within the specified time, an investigation of the carrier shall be conducted, which may take several days (e.g. 21 days as regards la Poste). During this time, no refund may be made or replacement parcel sent. On receipt of your order, we recommend you verify the compliance of your delivered products with your order and specify, if need be, on the delivery slip, together with your signature, any anomaly thereof.
Without prejudice of the applicable legal guarantees, we recommend you address any reserve as regards non-compliance of the products existing on the date of delivery, as soon as possible, by mail to SIE, 45 avenue de la Faisanderie - 94290 Villeneuve le Roi, or email sav@fire-design.fr.

Returned products shall be accepted, provided they are in their original condition, notably, that is to say with their packaging, accessories and instructions for use. Shipping and handling shall be borne by the User. Sometimes, a parcel arrives in poor condition, crushed and the Fire design extinguisher's appearance is damaged. This inconvenience is beyond our control, and only our carrier, la Poste, shall be held liable. On receipt of the parcel, we therefore ask you to refuse to take delivery of the parcel and to specify the cause of refusal (delivery in poor condition). The product will then be returned to us with no additional cost. We will then send you a new order, as soon as possible. If however you accept this parcel, you will bear the cost of returning it to SIE, 45, avenue de la Faisanderie – 94290 Villeneuve le Roi, for a new delivery. In the event of recognised non-compliance, SIE will replace the product. We advise you that a delay in delivery of 72 hours is possible as regards the delivery of your order. On account of security reasons, any order paid for by credit card is the subject of verification by SIE.

You may be asked or required to provide additional information to validate your purchase. Consequently, and with the purpose of avoiding any delay, please specify when placing your order:
- a professional email address or email address for which the user pays (e.g. AOL, WANADOO, NOOS, TISCALI…).
- fixed-telephone number (place of work or home) where you can be reached at any time during the day.

Moreover, for any order on the website www.fire-design.fr for an amount above a ceiling of 200 euros fixed by SIE, proof of identity and proof of residence must be sent to us by fax, email or mail.

We apologise for any inconvenience, however these measures are proof of our wish to protect our customers from possible credit card fraud.

5- VAT REFUNDS

Customers residing abroad (outside EU) may be entitled to a VAT refund. For this, once the parcel has been received, you must send us a photocopy of the invoice and proof of residency abroad.
Once in receipt of the customs note, the User must send it to us, together with a bank account identification document, then SIE will reimburse the VAT by cheque.

For VAT refunds, 3% of refunds will be deducted for "processing costs".

6- SECURED PAYMENT

All payments made on www.fire-design.fr are assessed and controlled by our bank CREDIT AGRICOLE. SIE offers 2 modes of payment:
Credit card (CB Eurocard, Visa or Mastercard),Cheque (enclose a photocopy of identification, purchase order, your contact details).

For payment by credit card, your account will be debited when you place the order, provided you have first obtained authorisation of debit of your account from the relevant payment centres, without which your order will not be processed. Online payment by credit card is performed via the SSL (Secure Socket Layer) security system, which allows for encryption of your bank details, when they are sent online.

For payment by cheque, you need to send us, together with the summary of your order, your cheque payable to SIE, addressed to Sécurité Incendie Européenne, 45 avenue de la Faisanderie – 94290 Villeneuve le Roi. As soon as we have cashed your cheque, we will send you your order.

7- CANCELLATION INSTRUCTIONS. SATISFIED OR REIMBURSED

For the purchase of a product on the website www.fire-design.fr, you have 7 clear days, provided for by article L 121-20 of the French Code of Consumption, to return a product with which you are not satisfied. Within this time limit you may return the product, at your expense, together with the invoice.
We recommend you return the merchandise by recorded delivery letter or mail follow-up and possibly take out insurance from the carrier for the market value of the products. This is required in the event of theft or loss of the merchandise by their services. In any event, return is made at the consumer's expense and risk.

Only products in new condition and complete (accessories, directions for use), returned in their original packaging, shall be accepted,. Any product that has been damaged, or the original packaging of which that has sustained damage above that expected from opening, will not be refunded, or partially refunded under the conditions shown hereunder. Should the article be sent back to SIE incomplete or damaged, a deduction of the refund shall be applied according to the analysis performed by the After Sales Department.  SIE will justify this discount by sending the customer a document drawn up by its After Sales Department. The time limits shown above shall start as of receipt of the order. This right of cancellation operates without penalty, except for postal charges. In the event of loss adjustment of the product within the framework of right of cancellation, SIE will undertake to reimburse the User as quickly as possible. Reimbursement shall be in the form of Credit to be used solely in the boutique.

For any return of parcel, you must either send the parcel(s) with la Poste (or other carrier) to Sécurité Incendie Européenne, 45 avenue de la Faisanderie – 94290 Villeneuve le Roi.
Please note that postal charges are to be paid by the customer.

8- DISPUTES AND LIABILITY

The present contract shall be governed by French law. SIE shall not be held liable for non-performance of the concluded contract, in the event of Act of God, on the one hand, in particular total or partial disruption or strike, notably of postal services and means of transport or communication, and, on the other hand, in the event of fault of the customer. We recommend you save the data contained in the purchased products. SIE may not be held liable for the consequences of the incorrect use of products sold on the website www.fire-design.fr.

9- COMMENTS, CRITICISMS, COMMUNICATION

All feedback posted by Users on the website www.fire-design.fr are controlled and moderated by the marketing team.
Should the content infringe the law and moral code (abusive advertising, defamatory statement, insults, out of context comments…) SIE reserves the right to refuse or to alter the concerned opinion.

10- PROTECTION OF PERSONAL DATA

Because the Information you give us is essential for the processing and distribution of orders and invoice processing, its absence shall lead to the cancellation of your order. By registering on the website www.fire-design.fr, you undertake to provide us with true and sincere information concerning yourself.  Communication of false information is a breach of the present general terms and of the terms of use shown on the website www.fire-design.fr.  Pursuant to the law of "Computing and Personal Information", the processing of your information is subject to a declaration with CNIL [national commission for information technology and civil liberties]. SIE and Fire design are authorised to take, process and use information concerning you. This data shall be the subject of computer processing.
This activity is strictly regulated: the file has been registered with CNIL, under the number 1365003. You have permanent access and rectification of any data concerning you, pursuant to EU provisions and national laws in force (article 34 of the law of 6 January 1978). At any time, you may send a request by mail to SIE, 45 avenue de la Faisanderie – 94290 Villeneuve le Roi, or by email on the website www.fire-design.fr to be informed of which information SIE has concerning you. You may, at any time and on request amend this data. If you accepted, when you registered on the website www.fire-design.fr, to receive promotional emails offering new products, exclusive offers, special offers… these will be sent to you.

At any time, you may request to stop receiving emails from us, by clicking on the link provided for that purpose and provided at the bottom of the page of each email that we or one of our partners will send you.

Drawings, graphics and vinyl collections are the exclusive property of the company SIE. No reproduction is authorised without SIE's prior agreement.
